Welcome to Nema – Iraq's marketplace for rescuing surplus food and reducing waste.
By using nemafood.com or our apps, you agree to these terms. If you don't agree, please don't use our platform.

Who We Are

Nema is operated by [Nema Company], registered in Iraq. We're a tech platform connecting you with local restaurants, bakeries, and stores selling surplus food at great prices.
When we say "Nema," "we," or "us," we mean our company. "You" means anyone using our platform.

Key Definitions

  • Nema – Our platform (app & website)
  • You – Anyone with a Nema account
  • Merchants – Restaurants and stores selling surplus food through us
  • Products – Surplus food items and related goods available on Nema
  • Order – Your purchase through the platform

How Nema Works

We help you discover and buy surplus food near you. Features include:
  • Browse offers based on your location
  • Place orders and track them
  • Pick up in-store or get delivery
  • View your order history
Important: We don't make or sell the food. We're a marketplace connecting you with merchants who do. Food availability changes based on what's actually surplus at any moment.

Creating Your Account

  • Registration is free and requires your mobile number
  • One person = one account (no duplicates)
  • Keep your login details secret – you're responsible for account activity
  • Give us accurate info (name, phone, address, payment details)
  • Update your details if anything changes
We may suspend or close accounts that violate these terms without warning.

Using Nema Responsibly

By using our platform, you agree to:

✅ Keep your account secure
✅ Not impersonate others
✅ Use Nema legally and ethically
✅ Not create fake orders or accounts
You release Nema from liability for losses caused by your account being hacked due to your negligence.

Orders & Payments

Placing Orders

  • Browse, select, and pay through the app
  • Order is confirmed only after payment completes
  • Prices include all fees and taxes unless stated otherwise

Payment Methods

We accept electronic payments through secure third-party providers. You're responsible for:
  • Payment accuracy
  • Using only cards you own or are authorized to use
  • Any fees charged by your bank or payment provider

Nema Surprise Bags

Due to the nature of surplus food, merchants create "Surprise Bags" – pre-set packages of available items. When you buy one:
  • You authorize the merchant to prepare the bag based on the description
  • Contents vary based on actual availability
  • Pickup times are strict and shown at purchase

Delivery & Pickup

Store Pickup

  • Show your order number at the selected store/branch
  • Arrive during the pickup window shown in the app
  • Late pickups: No refunds if you miss the window and the store closes or items sell out

Delivery

  • Ensure your address and phone number are correct
  • Be available when the driver arrives
  • No response for 5+ minutes? We may cancel the order without refund
  • Delivery fees vary by distance
  • Estimated times aren't guaranteed (traffic, weather, etc.)

Cancellations & Refunds

Quality & Safety

  • We don't guarantee food quality. Merchants are responsible for what they sell.
  • Check for allergies – we rely on merchant-provided info
  • Surplus food may vary in appearance, size, or freshness
  • Eat at your own risk. We're not liable for foodborne illness or allergic reactions

Your Wallet

  • Top up using app payment methods (valid 1 year)
  • Earn wallet credit from refunds/rewards (valid 180 days)
  • Rewards/cashback expire in 5 days
  • Wallet balance is not refundable for cash – use it on Nema only
  • Unused balance expires per above timelines

What You Can't Do

🚫 Fraud or fake orders
🚫 Stolen payment cards
🚫 Harassment of drivers or merchants
🚫 False reviews or defamation of Nema
🚫 Misuse that damages others
Violations = account suspension + possible legal action

Intellectual Property

Everything on Nema – logos, designs, software, content – belongs to us. Don't copy, modify, or use it without permission.

External Links

We may link to other websites. We're not responsible for their content, privacy practices, or any harm from visiting them.

Force Majeure

We're not liable for delays or failures caused by events beyond our control – natural disasters, wars, government actions, internet outages, etc.

Limitation of Liability

Our responsibility is limited to:
  • Refunding your order amount if the merchant can't fulfill it
  • That's it.
We're not liable for:
  • Food quality, taste, or safety issues
  • Allergic reactions
  • Delivery delays from traffic/weather
  • Indirect damages (lost profits, etc.)
  • Driver or merchant actions (they're independent contractors)

Indemnification

You agree to compensate Nema for any losses, claims, or damages we suffer because of your:
  • Violation of these terms
  • Misuse of the platform
  • Illegal activities

Changes to These Terms

We may update these terms anytime. Continued use after changes = acceptance. Check back periodically.

Governing Law

These terms follow Iraqi law. Any disputes go to courts in Baghdad.
If any part of these terms is invalid, the rest remains enforceable.
Arabic text prevails if there's any translation discrepancy.
